Province Permits Virtual AGMs Without Previously Required By-laws

Dickenson Condo Management has been encouraging all of our Board to pass Electronic Voting By-laws at their next AGMs, so owners could still participate in the Corporation’s affairs in a safe way.  The Province of Ontario has now released an Emergency Order permitting virtual or electronic meetings (and therefore voting) during this unprecedented time.

Government Issues Emergency Order for Virtual Meetings and Annual Meetings

The Condominium Authority of Ontario (CAO) released the following information yesterday evening:

The Condominium Authority of Ontario (CAO) is pleased to advise that on April 24, 2020, the Government of Ontario took further action to support corporations, including condominium corporations, co-operative corporations, business corporations, and not-for-profit corporations during the COVID-19 outbreak with amendments to Ontario Regulation 107/20 (the “Emergency Order”).

 

The Emergency Order is in effect province-wide and retroactive to March 17, 2020 (i.e., the day the Declaration of Emergency came into effect) and can be accessed by clicking here.

 

Regarding the effect on condo corporations, the Emergency Order was amended to assist the condo community in Ontario during the COVID-19 pandemic by:

 

1.   Permitting condo corporations to hold meetings and vote by telephonic or electronic means, notwithstanding current requirements or restrictions;

2.   Extending the time period to which condo corporations must hold annual general meetings; and

3.   Addressing additional matters related to meetings for condo corporations, such as the re-issuing of notices to hold a meeting by telephonic or electronic means after a notice of meeting has already been sent.
